Atriplex Hosting agrees to furnish services to the client, subject to the following (Terms of Service). Atriplex Hosting, the company hereafter referred to as Atriplex Hosting and The Client. Use of Atriplex Hosting constitutes acceptance and agreement to ToS (Terms of Service). All provisions of this contract are subject to change from time to time at the discretion of Atriplex Hosting. Clients understand that change to the ToS by Atriplex Hosting shall not be grounds for early contract termination or non-payment. You will be notified of any changes to the terms through an email or other form of communication.

REFUNDS AND DISPUTES

All eligible hosting service orders are eligible for refunds within the first 72 hours of the creation of the server in our database, this point is not marked by the time at which your initial payment is processed and may differ by several hours. All refunds are made through the gateway in which initial payments were made. All of our other services, including product addons and domains are not eligible for a refund. Refunds cannot be requested without probable cause; in addition to this non-monthly terms are non-refundable. To request a refund, you must submit a refund request via a support ticket system outlining the reason. If you meet the terms of eligibility, a refund will be issued by a team member. Refunds will not be issued automatically.

CANCELLATIONS

To terminate your services you must cancel via our billing area at https://billing.atriplex.co using the cancellation request form. A cancellation request must be submitted when a client wishes to no longer proceed with their service. Accounts with a credit card on file will automatically attempt to renew until cancelled. Unless specified per special arrangement, Atriplex Hosting do not hold our clients accountable to any contracts. Atriplex Hosting clients can cancel at any time.

EXPLOITATION

Clients are disallowed from exploiting services to modify settings of features beyond which they are permitted in their rental agreement. For example, a client may not modify their allocation of system memory (RAM) to an amount which differs from what they are renting from us.

LIABILITY LIMITATION AND EXCLUSION

While we do our best to keep your data backed up and always available, Atriplex Hosting, under no circumstances, shall be held liable for any data loss. Atriplex Hosting shall not be held liable for any disruption, delay, or disconnection of services for any period. We reserve the right to terminate a client’s services in the event of a charge dispute, despite the outcome of the dispute.

SUPPORT

Any support requests required for products from Atriplex Hosting shall be submitted through the billing system via tickets. Any other form of contact other than the predetermined ticket system is not guaranteed a proper answer from an official representative.

TERMINATION

We reserve all rights to terminate your server or service upon any violation of these terms or any other basis if deemed needed. Services which are suspended for non-payment will be terminated 7 days after the renewal invoice is due. We do not terminate services without cause.

LEGAL CONTACT

Atriplex Hosting retains the right to seek and consult with any appropriate authorities that may need to be involved in the event of an issue arising whether it is through violation of this policy or any other illegal occurrence requiring the involvement of law-enforcement agencies. Atriplex Hosting regards any communication between parties as confidential, upon distribution of any communication, unless prior approval is in place, we will take action to the full extent of the law. By purchasing a server from Atriplex Hosting you permit us to modify your server, this includes, but is not limited to, changing settings, uploading/mods, and other tasks related to running any server. Any verbal or written action to compromise our server systems or any other equipment owned by Atriplex Hosting will be taken seriously and will result in further investigation and possible lawsuits. Upon cancellation of payments to Atriplex Hosting your server will be suspended unless prior arrangements are made. Files will be kept as long as possible after termination or suspension, and for at least 30 days after the end of the billing cycle. Atriplex Hosting retains the sole right to stop, start, and modify your server at any given time for diagnostic or maintenance purposes.

UPTIME SLA

For products that include an uptime SLA (Service Level Agreement), Atriplex Hosting warrants the server from any hardware or network malfunctions. If it is proven that downtime is a result of our services malfunctioning, and not an issue related to the application or client, then we will issue a 50% refund of the monthly payment for the service. For example, a server that comes with a 99.9% uptime SLA means that the server is guaranteed to be functional for 99.9% or greater of the billing period (eg. a month). The customer can request the compensation by creating a support ticket through the billing area (https://billing.atriplex.co).

UPDATES TO OUR TERMS

Updates to our Terms of Service and Privacy Policy (the “Terms”) will be published on our Site. Clients that have an active service with Atriplex Hosting will be notified through email of updates to the Terms, to the email address we have on record for the account. Any updates to the Terms will take effect on the next billing cycle for all services. For example, if a client orders a monthly service on Jan 3rd, and we update our terms on Jan 5th, the updated Terms take effect on Feb 3rd.
